Folks, I’m sipping my coffee and reading about the Trump administration’s latest move to add a $103,265 fee for H-1B visas, and I’ve got to say, it’s a doozy. Months after a federal judge voided their previous attempt to require a $100,000 application fee, they’re at it again. I guess you could say they’re not ones to give up easily. The administration says the fee would help “recover” the costs of running the immigration system and encourage companies to hire American workers and pay them more. Sounds like a plan, but I’m not sure it’s going to fly.
The proposed regulation was posted on Monday, and it’s not final yet, so we’ll have to wait and see how this all plays out. The public has 30 days to submit comments, and I’m sure there will be plenty of opinions on this one. H-1B visas are for foreign professionals who want to work in specialized fields, and applicants need a bachelor’s degree or equivalent. The visa is valid for three years and can be renewed for another three years.
Economists say the program helps US companies stay competitive and grow their business, creating more jobs. There are 65,000 H-1B visas available annually, with 20,000 reserved for people with advanced degrees from American universities. But the Trump administration thinks the program is overused and prevents companies from hiring American workers. Vice President JD Vance is on board with the new proposed fee, saying that if an American corporation needs workers, it should hire and train Americans.
This isn’t the first time the administration has tried to impose a hefty fee on H-1B visas. Back in September 2025, President Trump signed an executive action imposing a $100,000 fee, which was a big jump from the previous $3,000 fee. But that didn’t quite work out, as US District Judge Leo Sorokin threw out the fee in June, saying the president didn’t have the authority to impose the new policy.
The judge’s decision was a setback for the administration, but they’re not giving up. They’re trying again with a new proposed fee, and we’ll have to wait and see what happens next.
