Folks, I’m sipping my coffee and reading about the latest Supreme Court decision, and I’ve got to say, it’s a doozy. The Court just blocked President Trump from suspending hormone therapy and other treatments for transgender Americans in federal prisons. Now, I know what you’re thinking, this is a big win for transgender rights, and you’re right. But let’s not get ahead of ourselves, the Court’s decision was a brief one-sentence order that didn’t explain the reasoning behind it. I guess that’s just the way the cookie crumbles sometimes.
The Supreme Court has been busy lately, and this decision is a bit of a surprise given their recent track record. Since Trump returned to power last year, the Court has allowed the administration to ban trans people from serving in the military and permitted a policy that requires the sex designation on US passports to align with a traveler’s sex assigned at birth. They’ve also upheld state laws that prohibit transgender athletes from playing on girls’ sports teams. So, this decision is a bit of an outlier, but I suppose that’s what makes it interesting.
Now, I know some of you might be thinking, “Big Elephant, what’s the big deal about hormone therapy in prisons?” Well, let me tell you, it’s a complex issue. The Trump administration had argued that the previous policy of providing hormone therapy and other treatments was arbitrary and capricious, and that it raised security and prison-administration concerns. But, on the other hand, the American Civil Liberties Union argued that the policy was a necessary accommodation for transgender inmates, and that it had been in place for decades without any major incidents.
The case was brought by three prisoners who had been receiving hormone therapy for years, and they argued that the abrupt change in policy would end treatment for nearly 1,000 people in custody. The ACLU pointed out that there hadn’t been a single security incident related to the provision of hormone therapy in the past 30 years, which makes you wonder what the administration was thinking. Maybe they just wanted to stir up some controversy, who knows?
Two conservative justices, Clarence Thomas and Samuel Alito, dissented from the decision, but they didn’t give a reason why. I guess that’s just the way it goes sometimes. The lack of explanation is a bit strange, given that the case had been fully briefed and was ripe for a decision. But hey, that’s just the Supreme Court being the Supreme Court, right?
In conclusion, this decision is a big win for transgender rights, and it’s a bit of a surprise given the Court’s recent track record. The issue is complex, and there are valid arguments on both sides. But ultimately, the Court decided that the administration’s policy was not justified, and that’s that. As I always say, you can’t make this stuff up, folks. And on that note, I’m going to go refill my coffee cup, because this story has left me feeling like I need a caffeine boost 🙃.
