A federal judge in Boston has dismissed the Trump administration’s multi-billion-dollar lawsuit against Harvard University, and I’m not entirely surprised. The lawsuit alleged that Harvard failed to protect its Jewish students from discrimination, but it seems the judge wasn’t convinced. US District Judge Richard G. Stearns, a Clinton appointee, wrote that the incidents highlighted by the government were “too isolated and episodic” to justify the claim that Harvard was in violation of Title VI of the Civil Rights Act.
The Trump administration had argued that Harvard breached its contract with the federal government under Title IX, which prohibits discrimination based on race, color, or national origin in programs that receive federal funding. They pointed to incidents of antisemitism on campus, including many in the immediate aftermath of the Hamas attack on Israel on October 7, 2023. But Judge Stearns wasn’t having it, and I can see why. The incidents were mostly isolated, and Harvard has been working to address antisemitism on campus.
I have to say, I’m a bit amused by the whole situation. The Trump administration has been going after Harvard for a while now, and it seems like they’re not giving up anytime soon. Harmeet Dhillon, the Justice Department’s assistant attorney general for civil rights, said the administration disagrees with the ruling and is assessing next steps. Bless their hearts, they’re not ready to throw in the towel just yet.
The lawsuit was a marked escalation of the protracted battle between Harvard and the White House, which has featured multiple lawsuits and on-and-off negotiations. Harvard has largely refused to comply with the administration’s demands, saying government efforts to interfere on campus are an overstep of its First Amendment rights. And I think they have a point. The government should be careful not to overstep its bounds, especially when it comes to academic institutions.
In its motion to dismiss the case, Harvard argued that the anti-discrimination claims by the Trump administration were a pretext in its ongoing dispute with elite educational institutions over federal funds. Harvard attorneys wrote that “this litigation is a continuation of the Government’s ongoing campaign of retaliation against Harvard for refusing to capitulate to government demands and for exercising its First Amendment rights.” That’s a pretty strong statement, and I think it’s worth considering.
When the Trump administration filed the lawsuit, they accused Harvard of being “deliberately indifferent” to discrimination against Jewish college members. They highlighted some pretty disturbing instances of antisemitism, including students being spit on and jeered with calls of “Heil Hitler.” But Harvard pushed back, accusing the administration officials of ignoring its “extensive efforts” to address known issues on campus.
In the end, it seems like the judge sided with Harvard, and I think that’s the right call. The Trump administration can’t just strong-arm academic institutions into doing their bidding, especially when it comes to sensitive issues like antisemitism. Harvard has been working to address the problem, and I think they should be given the chance to continue doing so without government interference.
So, what’s the takeaway from all this? Well, it seems like the Trump administration’s lawsuit against Harvard has hit a roadblock, and I think that’s a good thing. Academic institutions should be free to govern themselves, and the government should be careful not to overstep its bounds. And as for Harvard, they should keep working to address antisemitism on campus, because that’s the right thing to do.
