He even went so far as to say that an affair, or a cover-up of an affair, is not within the “outer perimeter” of the President’s official responsibilities. Bless their hearts, Trump’s team is still trying to argue that the case should be moved to federal court.
It’s worth noting that Trump was sentenced to unconditional discharge, meaning he faced no penalties, but it still made him the first president convicted of a felony. His lawyers are appealing the conviction, and they’re trying to get the case moved to federal court, which would potentially give them a faster route to the Supreme Court. But for now, it seems like they’re striking out.
The debate is still ongoing, with Trump’s team arguing that Manhattan prosecutors improperly introduced evidence involving White House staffers’ actions at the hush money trial. But Hellerstein disagreed, saying that a president’s assistant can work on unofficial, personal matters for the president. It’s a bit of a mess, if you ask me.
In the end, Trump’s lawyers are going to file an appeal, because why not, right? They’re saying that the Supreme Court’s decision on immunity and other legal precedent mandate that the case be removed to federal court and overturned.
