Judge Stomps on Feds Over Trans Kids' Med Records

Folks, I’m sipping my coffee and reading about a federal judge who has temporarily blocked the Trump administration from getting their hands on some sensitive medical records from healthcare institutions in New York City. Apparently, these records are related to gender identity care provided to minors in recent years. I’m thinking, what’s the big deal here? The Trump administration is trying to investigate the provision of gender identity care, and numerous courts around the country have viewed this as an improper fishing expedition. Yeah, because that’s exactly what it sounds like – a fishing expedition.

I mean, come on, the government is trying to get their hands on medical records, including diagnoses, informed consent records, and even the revelation of plaintiffs’ transgender status. That’s some pretty personal stuff right there. And the judge, Katherine Polk Failla, is having none of it. She’s saying that this type of information is “squarely within the class of intimate materials warranting the strongest constitutional protection.” I’ve got to agree with her on that one.

So, Judge Failla has provisionally certified a class of individuals who received care from a New York City provider over the past six years, and she’s issued a temporary restraining order that bars investigators from obtaining the records. I’m thinking, good for her. I mean, can you imagine if the government started snooping around your medical records without a good reason? Not cool, folks.

The judge is quoted as saying, “Because I cannot conceive of a crime that would require the breadth of disclosures in the subpoena – identifying and sensitive medical information for an entire class of people for a six-year period – I have to find that the government’s interest does not outweigh the plaintiffs’ interest in privacy.” I’ve got to say, that’s some pretty sound reasoning right there. I mean, what’s the government trying to achieve here?

It’s worth noting that this story is still breaking, and I’m sure we’ll be hearing more about it in the coming days. But for now, it seems like the Trump administration has hit a roadblock in their investigation. And I’ve got to say, I’m not shedding any tears over it.

In conclusion, it seems like the Trump administration’s fishing expedition has been put on hold, at least for now. And I’ve got to say, I’m relieved that there are still some judges out there who care about people’s privacy. As I finish my coffee, I’m thinking, you can’t just go around snooping on people’s medical records without a good reason. That’s just not how it works, folks. And with that, I’ll just say, bless the judges who still care about our constitutional rights 🙏.
