I’m sipping my coffee and reading about this Lindsay Clancy case, and folks, it’s a real head-scratcher. She’s claiming a voice in her head told her to kill her kids and herself, and now she’s suing her medical providers. I mean, you can’t make this stuff up. According to the lawsuit, Clancy said “I lost all control. My body started acting without any control on my part,” and that she was “just following commands, ‘all action.'” This voice allegedly demanded action, and now her attorneys are going for an insanity defense.
As I’m reading this, I’m thinking, this is going to be a tough sell. I mean, the insanity defense is not exactly a get-out-of-jail-free card, despite what some people might think. Joni Johnston, a forensic psychiatrist, told CNN that it’s a pretty rare defense to use, and an even rarer one to be successful. She said, “I think there’s an ongoing kind of perception that insanity pleas are kind of a get-out-of-jail-free card that attorneys throw on the table.” Yeah, no kidding.
Now, I’m no expert, but it seems like Clancy’s case is similar to that of Andrea Yates, the Texas mom who drowned her five kids in the bathtub back in 2001. She pleaded not guilty by reason of insanity, and after a retrial, a jury actually sided with her. She’s still institutionalized, though. And then there’s the case of John Hinckley Jr., who shot President Reagan and three others in 1981. He used the insanity defense and was found not guilty, but he spent nearly 30 years in a mental hospital.
The more I read about this, the more I’m thinking that the insanity defense is a bit of a wild card. I mean, if jurors find Clancy not criminally responsible for the deaths of her kids, she’ll likely end up in a state psychiatric hospital.
