This time, it’s a defamation lawsuit that the Trump Media and Technology Group brought against The Washington Post in 2023 over a story titled “Trust linked to porn-friendly bank could gain a stake in Trump’s Truth Social.” I mean, who comes up with these story titles, right? Anyway, a federal judge in Florida has thrown out the suit, saying that Trump Media “failed to present evidence that would allow a jury to find by clear and convincing evidence” that The Post “published the allegedly defamatory statements with actual malice.”
I’m not surprised by this outcome, to be honest. It seems like Trump Media has a hard time proving “actual malice” in these defamation cases. The Post’s lawyers argued that Trump Media couldn’t meet the high legal standard that public figures must meet to prevail in a defamation case, and it looks like the judge agreed. The Post’s reporter, Drew Harwell, “thoroughly investigated” the subject and “had confidence in the article’s accuracy at the time of publication,” which probably didn’t help Trump Media’s case.
Somewhere in Atlanta, a producer thought this story sounded like a big deal, but it’s just another day, another lawsuit for Trump Media. The company has been losing money for years, making less than $1 million in revenue in the first quarter of this year, according to public filings. Maybe they should focus on making some actual money instead of filing lawsuits all the time. I mean, they’ve got a social network, Truth Social, but it’s not like it’s taking the world by storm or anything.
The Post itself reported on the legal victory, saying they’re “pleased with the court’s decision and look forward to reviewing its written order upon release.” Trump Media, on the other hand, is still considering whether to appeal the ruling. They told The Post, “We believe a jury should decide whether these falsehoods were actionable and will evaluate whether to appeal last week’s ruling in due course. We will also continue to hold the media accountable.” Yeah, because that’s worked out so well for them so far.
I’ve got to wonder, what’s the end game here? Is Trump Media just trying to get attention, or do they actually think they can win some of these lawsuits? The company has repeatedly filed lawsuits over news coverage it deemed false, but they keep getting thrown out. Maybe it’s time for them to try a different strategy. After all, you can’t win ’em all, right?
In any case, it’s not like this is the first time Trump and his businesses have gotten publicity from lawsuits, only to see judges later throw them out. It’s almost like they’re trying to create a sense of drama or something. In April, a federal judge dismissed Trump’s defamation lawsuit against The Wall Street Journal over its reporting on a lewd birthday letter to Jeffrey Epstein bearing his name. Trump refiled that suit in May, because why not, right? He’s also got pending litigation against the BBC, The New York Times, and the Des Moines Register. It’s like he’s trying to keep the lawyers busy or something.
In conclusion, it’s just another day in the world of Trump Media and their lawsuits. The judge threw out the case, and The Post is happy about it. Trump Media is considering an appeal, but we’ll see how that goes. As I finish my coffee, I’ve got to say, it’s been an entertaining read, but I’m not sure how much more of this I can take. Maybe next time, Trump Media will actually win one of these lawsuits, but I wouldn’t hold my breath if I were you. 😊
