A federal judge, US District Judge Tim Kelly, has temporarily restored the access of CNN, MS NOW, and Politico to the White House, and now these organizations are asking him to extend this order. They’re claiming that the ban is an “unlawful assault on the most fundamental First Amendment freedoms.” I mean, you can’t make this stuff up – the White House is trying to punish these outlets for their coverage, and it’s just not flying with the judge.
The new filing from the news organizations says that the administration’s actions are “retaliate” against them, and that the motive is to “punish and chill journalism they dislike.” Well, bless their hearts, it seems like the White House is trying to control the narrative here. But the judge is having none of it, and he’s signaled that he’ll consider additional evidence explaining the supposed justification for the ban.
It’s interesting to note that the outlets are arguing that even as the administration tries to push the national security reasoning in court, Trump and other officials have said that the ban is about punishing negative coverage. Somewhere in Atlanta, a producer thought this sounded terrifying, I’m sure. But in all seriousness, it’s a pretty bold move by the White House to try to ban these outlets, and it’s not surprising that the judge is pushing back.
The judge’s order expires on October 8, and the outlets are asking for a preliminary injunction to maintain their access while the lawsuit plays out. They’re also encouraging the judge to adopt a broader legal rationale for keeping Trump’s ban on hold, emphasizing the alleged First Amendment violations. It’s a bit of a circus, but I suppose that’s what happens when you try to ban the press from doing their job.
The White House has tried to claim that the coverage from these outlets has “threatened national security and/or spread falsehoods,” but the judge isn’t buying it. He’s rejected the administration’s argument that the letters they sent to the outlets outlining their concerns were enough to overcome due process concerns. It’s a bit of a game of cat and mouse, but it seems like the judge is trying to do the right thing here.
In conclusion, this whole saga is a bit of a mess, but it’s also a reminder of the importance of a free press. The White House can’t just ban outlets that they don’t like, and it’s up to the courts to ensure that the First Amendment is protected. As I always say, you can’t make this stuff up – but thankfully, the judge is on the case, and I’m sure we’ll see more of this drama play out in the coming weeks. And who knows, maybe the White House will learn that you can’t just silence the press with a wave of your hand – that’s just not how it works, folks.
